It is agreed before the game:All games played at QueenAlice.com are subject to time controls. The type of time controls used on a game is determined by the players when the game is created. There are two main types of time controls available:

* Per move: Each player is assigned a maximum of reflection time per move. After a move is made the game clock is reset and assigned to the opponent for the next move. This type of time controls ensures that the game progresses smoothly.
Options: 1, 3, 7 and 14 days per move.

* Per game: Each player is assigned a maximum of reflection time for the whole game. This type of time controls is good for games that need to have a known end date.
Options: 10, 30, 60 and 90 days per game per player

On-The-Boards players are also subject to time controls. And yet the rule saying that if a player has no time but his opponent cannot mate (even with worst play), this is a draw.
This is a fundamental rule of chess. It is like Queen Alice didn't allow you to castle...

Rule 6.9 covers what you say.

Interestingly the International Chass Code in Chess for Fun and Blood by Edward Lasker (Which I thought were the rules of chess) has a couple of quirks compared with the current FIDE rules:
1) The 50 move rule is void in positions that theoretically take more than 50 moves to win -
Exception shall be made for certain positions where theoretically more than 50 moves are necessary to force a checkmate and in this case a number of moves double the number establisged by theory as being necessary for this object shall be allowed in lieu of the 50

2) A game must be claimed as won on time if the clock says so (i.e. games should be auto claimed
If the Player exceed the time allowed for the consideration of moves, the official in carge shall declare without making any exception the game lost by the Player (even if he and the Opponent object)
