| The problem is that the opponent must make a next move, after the third repeated move, to ask by the draw. This way the required draw is belated for one move. |
Perhaps the site could be programed to allow a player to force a draw on the same move in which he made the 3rd repeated move by the following procedure:
The player could select the move that would make the draw, and then, before pressing the 'move' button, mark the 'offer draw' box.
The server could be programed to check for a 3-fold repetition every time one marked the 'draw offer' box, and, whenever it detected the repetition, it could post a 'force draw' box.
The player could click on that box, and as soon as he pressed the 'move' button, the draw would take effect and the game would be over.
The above could also be used for the 50 move rule.
The 'force draw' box could also be put out whenever a position arose in which checkmate was impossible (such as with bare kings.)

While I understand some peoples view that a draw by repitition should not be automatically decided by the system, you will end up playing against some eejit who insists in playing on out of spite at not winning. This is why I think the only solution is that the system does decide on draw by repitition.

My understanding is that according to the official rules, when someone claims a draw according to the 3-fold repetition or 50 move rules, it is forced. That is, if the conditions are met, a draw is declared regardless of whether or not the other player wants to accept it.
However, if the conditions are met and neither player declares a draw, then the game continues until a draw is declared or someone is checkmated or stalemated (if possible.)
If someone offers a draw and none of the above mentioned conditions are met, the opponent has the option of accepting or rejecting it.
