Ok, now we seem to be talking the same thing. :)
Taking this point, maybe positions where nobody has material to mate should be draw. But it would be a little bit weird if the site recongnizes automatically draws but doesn't recognize timeouts. Of course they're different(u always have to claim for the won by timeout), but... both are ways of ending a match, right? :)
I support the FICS idea: one player has to claim the draw and the site approves it, I mean, instead of giving the opp the option...

Actually, I've just checked with FICS and it doesn't behave the way you described. For draws by threefold repetition and the 50-move rule, one player `offers' the draw and the server declares the game drawn without asking the opponent.[1]
However, for dead positions, the FICS server terminates the game automatically without requiring either player to claim the draw, just as it would for a checkmate.
[1] I had this happen to me once -- I thought I was offering my opponent a draw in an endgame where he was playing on pointlessly in a totally drawn position. I was a little surprised that he accepted very quickly, since he'd declined a draw offer earlier but, when I looked more closely, I realised I'd just claimed a draw by repetition!
