i have a game currently that is a draw by repetition (i offered a draw on my last move after repeating the position three times) it wasn't declared a draw, so if he doesn't accept what do i do?
also this game http://www.queenalice.com/game.php?id=34346 looks like it may go to draw by 50 moves. does that happen automatically? if not, how do i go about invoking that rule?

Right now the system doesn't detect those cases automatically, so please talk to your opponent about this. If he/she doesn't want to end the game let me know.

The official rules say:
The game is drawn when a player having the move claims a draw and demonstrates that at least [the last] 50 consecutive moves have been made by each side without the capture of any piece and without the movement of any pawn. This number of 50 moves can be increased for certain positions, provided that this increase in number and these positions have been clearly announced by the organisers before the event starts. The most extreme case yet known of a position which might take more than 50 moves to win is king, rook and bishop against king and two knights, which can run for 223 moves between captures! (http://www.chessvariants.com/fidelaws.html) The last capture was made in move 68, you're now in move 100. So 18 more moves to go
The other draw possibility:
The game is drawn, upon a claim by the player having the move, when the same position, for the third time:
(a) is about to appear, if he first writes the move on his scoresheet and declares to the arbiter his intention of making this move; or (b) has just appeared, the same player having the move each time.
The position is considered the same if pieces of the same kind and colour occupy the same squares, and if all the possible moves of all the pieces are the same, including the rights to castle [at some future time] or to capture a pawn "en passant".
This has, as far as I can tell not happened either. So as far as the rules go, nothing "illegal" has happened yet. Still, Reftutor, you still have a chance to win (King+Rook), whereas your opponent (King+Knight) has no chance, even if he takes your Rook. So it's not quite understandable why your proposed draw is not accepted. Good luck though!

nothing illegal happened, i was just curious what would have happened at move 118 because i knew the triple repetition was not automatic, so i was wondering about the 50 moves

Both the 50 move and 3 move repetition draws involve the notification of an arbiter/tournament director that such positions are about to occur. Since miguel, our webmaster, is our arbiter, he would rightly be the one to notify.
The only place I know of on the Internet that recognizes the 3 move repetition draw when played without an arbiter is ICC. However, even there it is not automatic - the player making the drawing move must also click the draw button after the move is made to have the draw occur.

On www.itsyourturn.com they programmed a draw after the same position occurred for the third time. Mind you, I feel it is up to the players to suggest and accept a draw.
