Well, FIDE states that: In any game where neither player has enough material to force a mate, or when (blah blah...other stalemate rules) the game is an automatic draw UNLESS a player's flag has fallen. This is where it gets complicated. If the players don't take a draw, or talk to the arbiter, and a flag falls, the opponent wins the game, even though it is a stalemate position.
I think thats why the automatic draw isn't programmed.

Of course it's draw. Anyway, I think it's obvious that someone has to say: "Hey, it's a draw! There's no why (to?) continue this game!'. There's no obscure force over the table saying "DRAW. DRAAAAWWWW". Do you understand now?
So: a player has to claim the draw. The opponent MUST accept. If he doesn't, the first player call for the arbiter. Just it. No one will die because of it.
